Grants are gifts of money that are given to the recipient mostly based on the merit or the need of the recipient. There are many types of grants and all are used for the greater good. Many are given out by the government as aid or as a way to “feed” a lackluster economy and in so doing raise the tax revenue for the government. One can think of both purposes as investments by the government because in both cases the stability or boost given to the recipient will get them back on their feet and being productive again which is better for the government than that area becoming a perennial drain on the economy.

Governments aren’t the only institutions that give out grants. Private organizations can give grants out as philanthropic sorts of gifts to the community in which they are located. The great thing about the grant for the recipient is that they are under no obligation to pay back or “work off” this money. The only requirements come on the front end in the form of eligibility requirements. There is generally a certain list of things that are considered appropriate uses for the money and will not be given out unless the benefactor of the money is sure that they will be used in this way. This whole process is carried out through applications.

People seeking grants will write a grant proposal or fill out an application detailing their eligibility and in many cases making a statement concerning their specific needs. There is often a certain form in which the benefactor expects these to be written, and in lieu of this there are often special positions held by employees of certain types of institutions that are responsible for all of the grant writing in that area.

The most common types of grants are student aid. These grants subsidize the cost of education for students who are either very talented or very needy. The idea is that the institution will only benefit by making a relatively small investment in the student’s future productivity. Other grants include public educational grants, research grants, product and technology development grants, relief aid grants, small business grants, and on and on. Again don’t think of these as free gifts that the government gives out of the generosity in their hearts. Rather this is money that the government is hoping will by helping its recipient on the front end reap major savings and/or profits on the hind end.

It is the greatest scam in history. I am amazed and highly offended by it. Global Warming; It is a SCAM.

A few financially motivated scientists have manipulated long term scientific data back in the late 1990’s to create an allusion of rapid global warming. Other scientists jumped into the circle to support and broaden the “research” to further enhance the totally slanted, bogus global warming claims. Their friends in government steered huge research grants their way to keep the movement going. Soon they claimed to be a consensus. Environmental extremist and politicians then teamed up with movie, media and other liberal environment journalists to create this “scientific” scenario of the civilization is threatened from the consequences of Global Warming unless we adhere to their radical agenda. Makes for good TV not science.

Now the manipulated science has been accepted as fact and become a cornerstone issue for CNN, CBS, NBC, the Democratic Political Party, the Governor of California, school teachers and, in many cases, well informed but very gullible environmental conscientious citizens. Only one reporter at ABC has been allowed to counter the Global Warming frenzy with one short documentary.

I do not oppose environmentalism. I do not oppose the political positions of either party. However, Global Warming, Climate Change, is not about environmentalism or politics. It is not a religion. It is not something you “believe in.” It is science; the science of meteorology. I am telling you Global Warming is a nonevent, a manufactured crisis and a total scam. I say this knowing you probably won’t believe me, challenging a Nobel Prize, Academy Award and Emmy Award winning former Vice President of United States. So be it. I feel the Nobel Prize committee should be ashamed of itself. If ever they made a fool of themselves this is it, they should revoke their prize and admit to their mistake.

The experts say our pollution has created an strong and increasing greenhouse effect and a rapid, out of control global warming is underway that will sky rocket temperatures, destroy agriculture, melt the ice caps, flood the coastlines and end life as we know it. How can I dissent from this crisis?

People who spend a decade at a university obtaining a PHD in Meteorology and becoming a research scientist, more likely than not, become a part of that single minded culture. They all look down at the rest of us, certain of their superiority. They respect government

With how incredibly expensive college has become over the last several decades, students are finding it even more difficult to find means of obtaining the funding required in order to afford their education. However, even with the incredible climbing costs, it has become so important to obtain college as more and more employees are only hiring those that actually have their degrees. Those that are obtaining their degrees are getting paid incredibly more than others in the same job without a degree. This has made the move to get a degree, one of the best investments that anyone can make, regardless of how the costs have risen to. Even with these costs, most college students are going to be able to make many times that amount over their lifetime all because they took the time and spent the money in order to get a degree that would help to further them.

The problem is that after you run out of sources for scholarship money and grants, you start to run out of options. This of course means that you are either going to have to find a means of paying for college out of pocket and working full time so that you can make ends meet, or you are going to have to find another source of money.

When most people are looking for additional money for education, they are most likely going to find themselves using a private loan. These loans of course can come from a great number of completely different companies, but for the most part they are all offering the same product.

For those that don’t know, there are two types of student loans, there are ones where you pay interest up front while you are going to school or ones where you don’t make any payments until 6 months after you graduate. You can choose either one, but generally the best one to pick is the low cost interest payment. This will save you a considerable amount of money over the life of your loan and won’t cost you all that much money to pay on.

Next, you have to realize that you can either get these student loans subsidized or unsubsidized. The subsidized loans are the ones that are backed by the federal government. This essentially means that the government is cosigning on your loan. They are saying that if you default they can be held responsible for the repayment of that loan. Because the government is backing the loan, you are able to get a much lower interest rate for the loan. This of course will save you a great deal of money on your loan in the long run.

If you are to take a loan that is unsubsidized this means that you are guaranteeing the loan on your own. This generally will result in you paying a somewhat higher interest rate, but usually it’s only a percentage point or two above what you would normally be paying anyway. Still, it is always recommended that you use the subsidized loans first and if you need the unsubsidized ones, then you take those ones. This will help you to save as much money as possible over the duration of your loan.

While the loan process can be somewhat complicated, colleges have financial advisers that will be able to help you through the entire process. Make sure that you take advantage of their free counseling so that you get the best possible deal for your education dollar.

Let’s face the reality. College education is expensive! A lot of parents do a double take when their children are preparing and looking forward to attending a community college or a state university.

There are a lot of things which comprises the cost of college education and the tuition fee is just a part of the big picture of getting into college. Other everyday expenditure includes food, transportation, housing, pocket money, and other miscellaneous fees which when added up can create a significant portion in financing a college education.

A lot of families in this day and age, even if they belong to the upper-class society, think about applying for financial aid. College grants and scholarships are the most excellent kind of financial assistance.

Grant and scholarship programs do not entail students or the family to pay back. These could be of two kinds: (1) base on need, which is given due to the financial inability of the student and the family as a whole, and (2) base on merit, the talent of the student like in sports, is the main consideration. The student’s academic ability also falls under the merit-base college grant and scholarship.

Oftentimes, college grants and scholarships combine the merit and need criteria to ease out the whole financial aid process. Numerous students and their families are in the look-out for this type of financial aid. However, college grants and scholarships are limited compared with the growing number of students year after year.

Qualifying students can avail of federal and a number of state scholarship programs. Some of which are the following:

Federal or National Pell Grants – this is a program funded nationwide intended to endow assistance to any qualified undergraduate learner pursuing postsecondary schooling. Grants and scholarships of this kind are given to those who have not finished a baccalaureate degree.

The worth of the grant can vary year after year and will depend largely on the financial need of the students, the expenses that will be incurred while attending the chosen university or college, and the availability of funds from the national government.
This type of grant will open opportunity for the students to avail succeeding financial aid from the national government.

Federal Supplemental Educational Opportunity Grant (FSEOG) – this is a program for ongoing undergraduate students with outstanding monetary need. However, not all students can avail this type of grant. This will depend on the eligibility of the students and availability of finances of the concerned school.

Another form of financial aid that students and families can turn to is through loans. This type of financial assistance should be paid back. The financial need of the family should be considered thoroughly to avoid paying high interest rates.

It is also a must to understand all the terms of lending agencies such as the schedule of repayment and interest rates, before signing in or making a commitment.

Work study is a form of financial assistance which calls for students to do labor to sustain their college education. Work study is commonly done on campus and is the most typical form of financial aid in all universities and colleges. Usually, the students will render service to schools for ten to fifteen hours per week.

Scholarships, grants and other forms of financial aid to acquire college education is really multifaceted, confusing at times, and even exasperating. The good thing is college education is a non-refundable and non-biodegradable type of investment. It is for the future!

RE: EMPLOYMENT UPDATE FOR 2009

Dear Friends, Clients and Colleagues:

Each year brings a new set of laws, regulations and scams. The number of new statutes, ordinances, regulations and case law continue to grow and impose an ever greater burden on businesses, especially small businesses and professional practices. Below is a brief review of some of the more important new laws that may impact your business or profession.

E-Verify

You may have heard about E-Verify, the computerized system by which an employer can match an employee’s identification with the federal government’s database of workers eligible for employment based on citizenship status. E-Verify is free to employers and, in the future, will be mandatory for all new hires. The system is reported to have about a 10% mistake factor. Because of the likelihood of mistake, you may want to delay signing-up for the E-Verify system.

Beginning summer of 2008, the Department of Homeland Security and Department of State are issuing “passport cards” which may be used to verify employment status.

Minimum Wage

California State minimum wage is not scheduled to rise in 2009 and will remain at $8.00. The Governator is also encouraging the introduction of other new laws to reduce the amount of wage and hour litigation, including litigation concerning meal and rest breaks violations that have plagued businesses. For the last eight years the courts have been terribly inconsistent on questions concerning an employer obligations to provide meal and rest breaks and how they may be implemented.

San Francisco minimum wage will go up to $9.79 per hour beginning January 1, 2009. Even if your office is located outside San Francisco, employees working within City limits must be paid this City specific minimum wage.

Computer Professionals: Labor Code Section 515.5 has been amended. If you employ professional computer oriented employees, effective 2009, the hourly amount they must be paid to be exempt from overtime is $36.00 per hour or an annual salary of $75,000.00. This amount will increase with the CPI January 2009. It is important to keep in mind that not all computer related employees qualify for the exemption under the duties test.

Meal and rest break compliance requirements remain unsettled in California since the Brinker case was granted review by the Supreme Court. To be safe, meal and rest breaks should be enforced and non-exempt employees must confirm, in writing, each day they take or don’t their breaks. It is essential that employees sign off on a notice confirming the company’s meal and rest break policy. It is the employer’s legal obligation to keep records on meal and rest breaks taken and these records should be kept in storage for a minimum of four years. Effective 2008, the statute of limitations concerning meal and rest break violations is four years. Not only are employers penalized for violating this component of the Labor Code, additional penalties can be added under Labor Code Section 203 which equal thirty days of wages for each affected employee.

Duty free meal breaks must be at least 30 minutes long and must be provided during the 5th hour of work, or before. Ten minute rest breaks should be made mandatory during the mid-morning and mid-afternoon. Though there is an exception to this rule for construction companies under very limited circumstances, the exception is so narrow it is best to follow the general rule.

The Brinker case also held that employers are liable for wages if they know or should know that employees are working off the clock. If you have employees who arrive at work early to avoid peak rush hour traffic and begin working before the regular workday or, if you have employees that run errands for the business before arriving at the office or after the official workday, this is compensable time.

The Starbucks case made it abundantly clear that business owners and employees holding a supervisory or management position may not take any portion of pooled tips even if they provide direct service to the patron.

Bradstreet vs. Wong confirmed the decision in Reynolds vs. Bement which held that officers and directors are not personally liable for corporate debts to employees for unpaid wages. Some of you might recall that prior to 2006 when the Reynolds case was decided, officers and directors were held liable.

What the court gives with one hand, it takes away with the other. This new case also opened the door for personal liability of the officers and directors. If the plaintiff/employee can pierce the corporate veil, the officers and directors may, in fact, be liable for unpaid wages.

What to do? Make certain you are following all mandatory corporate formalities so that your corporation cannot be pierced. This includes holding regular annual and special meetings, adhering to corporate bookkeeping requirements and otherwise following typical corporate formalities. If you haven’t held a corporate meeting in the last 12 months, it’s time to call my office.

In Lonicki vs. Sutter Health the court held that an employer cannot interfere with an employees outside employment, including employment with a competitor.

In Edwards vs. Arthur Anderson the court held that any non-compete signed by an employee is void as a matter of law. The court threw out the old defense of “narrow restriction”. However, trade secret agreements and confidentiality agreements remain enforceable provided they do not contain a non-compete component.

If your company provides computers, PDA’s, cell phones or other communication devises, check the company’s written privacy policy. If your company doesn’t have a privacy policy, now is the time to create one. In Quon v Arch Wireless Operating Company the court directed employers to be explicit regarding the scope of privacy extended to employees.

In the Quon case the court reversed a long line of cases that held that employees have no reasonable expectation of privacy with regard to the computers, cell phones and other electronic devises furnished by the employer. This is likely to be an area the court will explore again in the company years since more and more of our lives are spent using a variety of electronic devises that store conversations, text messages, emails and other forms of communication.

What to do? Make certain you have an explicit and comprehensive privacy policy signed by every employee.

The Americans With Disabilities Act or ADA has been revised and those revisions become effective January 1, 2009. The new law is titled the ADA Amendments Act. The provisions of the ADA have been greatly expanded in a variety of ways including a new more extensive list of covered disabilities. The new law excludes consideration of mitigating measures and expands the definition of “major life activity”.

What to do? Employers should be cautious of every decision to terminate, demote or taking any other adverse employment action against a covered employee. Most court watchers expect this newly expand law to generate a great deal of litigation in the coming years as the courts try to make sense of the greatly expanded provisions.

Family Leave has been expanded so that an eligible employee or spouse, son daughter, parent or next of kin of a covered service member is entitled to a total of 26 weeks of Family Medical Leave to care for the service member.

Scams:

Many of you continue to report the receipt of correspondence from companies offering to sell annual board of director meeting minutes to your company. The charges typically range from $100-200.00 for which you receive a fill in the blanks form, nothing more. These solicitations arrive in official looking envelopes that appear to come from the Secretary of State. Don’t fall for this expensive scam.

Because of the decision in Bradstreet vs. Wong referred to above, it is even more critical that your annual and special meeting minutes be done properly and that efforts be made to prevent anyone from piercing the corporate veil to attack you personally in litigation.

The above isn’t an exhaustive review of all the changes in the law that are of significance to your business and you can expect that as we wind through 2009, new cases will be decided and new laws passed by the state legislature and Congress that are of significance to your business or professional practice.

Best wishes for a healthy and happy new year.

Sincerely yours,

Steve

Tell me something I don’t know. America’s immigration system is broken, and it seems the current Government is not inclined to fix it. Many people are asking: When will the reform finally happen?

Â

I don’t know, but there are some indications. But first, let me ask: Do we need an immigration reform? Absolutely. Our immigration system is run by bureaucrats, not professionals. Care to know why I think that must change?

Â

I am sure you have heard about the recent “self-deportation” program “Scheduled Departure” of the U.S. Immigration and Customs Enforcement (ICE). A grand total of eight (yes, illegal immigrants showed up by the time it was scrapped. That idea was so hare-brained to begin with, only someone who lives on a different planet could have come up with that. Let’s start with the basic premise: illegal people turn themselves in to schedule their own deportation. Why in the world would any illegal in the U.S. do that? Without turning themselves in, they can live happily, earn a living, send money to their family in El Salvador or Mexico, and if they eventually get caught and deported … well, so be it. Further, bureaucracy is not known for its swift and courteous customer service. Airline service nowadays is lousy, but can you imagine what it must be when your flight is serviced by a deportation agency? If experienced immigration were in charge of the immigration, do you think that “self deportation” blunder would have ever happened? I let you answer that question.

Â

And what if the immigration service locks you up? Remember that the immigration service routinely locks people up in far away prisons and with jointly common criminals. I had a client a few years ago who foolishly applied for asylum upon her arrival at Dulles International Airport near Washington, DC. She promptly found herself locked up in a medium-security prison about four hours by car from Washington, DC.

Â

You are still not convinced we need an immigration reform? Let me give you a few more examples. There is a lot of fraud that needs to be weeded out, but it seems impossible with the current system. Just last week I had a Hispanic client, a carpenter, in my office seeking a second opinion in an immigration matter. His attorney had applied for a so-called “Labor Certification,” meaning immigration sponsorship through a business that needs that particular worker. He had paid that attorney a lot of money (which immediately made me suspicious), and sincerely believed that if the petition had been approved, he would have been able to work for that sponsoring business and receive permanent residence in the United States. Well, the attorney informed him that the petition had been denied because “the salary was too low.” Nonsense.

Â

Here is what I found out in just a few minutes on the computer: the attorney who filed the case was not an immigration practitioner, but apparently just wanted to make a quick buck before the so-called 245(i) law finally sunset in April 2001. That law permitted people who were illegal in the U.S. to have a business petition for their permanent residence, pay a $1,000 fine, and then “adjust status” (receive their green card) within the United States. The Labor Certification in this case was so poorly drafted, it could have never been approved. Furthermore, the alleged sponsoring company had been out of business even before the petition was filed. The hard-working carpenter simply got relieved of several thousand dollars by his attorney.

Â

If I can figure all of this out in about five minutes on my computer, so could any immigration officer, and at the same time stop (1) fraudulent petitions, and (2) shyster lawyers and “notarios” (self-declared immigration practitioners) who make money off such scams.

Â

Talking about scams, there is the lure of these green sheets of paper that people simply cannot resist. Did you hear about attorney Samuel G. Kooritzky of Arlington, VA? He sold fraudulent Labor Certifications like hot dogs, by the thousands. When he was arrested, he had $44,000.00 in cash on him. Not quite enough for a night of fun, but it is a beginning. His associate had $1 million in cash stashed under his bed.

Â

My favorite story is that of Robert T. Schofield. He worked for 30 years at the Washington District Office of the immigration service (previously INS, now USCIS), and was acting assistant director for examinations from 1998 to 2004. I had suspected for a long time that there was something wrong with him. He was there early every morning when people lined up to get into the immigration office, directing staff, attorneys and visitors. He was always on top of things (and often received kudos from immigration lawyers). And he was always impeccably dressed. He just didn’t look like a bureaucrat. And did not behave like one. Years before his arrest, he allegedly fled to China once with a pretty Chinese escort and charged $36,000 to his government-issued credit card. He came back, was made a supervisor, and sold U.S. citizenship to illegals for $10,000 a pop. When I called a colleague of mine who had previously practiced in Washington, DC, to inform him of the recent arrest of a “high ranking immigration official,” he immediately said “that must be Mr. Schofield, right?”

Â

How can such fraud be prevented? It is actually easy, and I have encountered some immigration officers who swim against the stream to do the right thing. For example, there is one particular immigration officer who adjudicates immigration petitions for medical doctors who work in rural areas. I had a couple of permanent residence applications for such foreign medical doctors who serve in areas where the regular medical graduates don’t want to go, and that immigration officer made phone calls to the hospital, to the beneficiary medical doctors, and to me as the attorney, to verify the information provided in the petition. In a few minutes, with just a few phone calls, the officer can verify that the doctor is real, and that he or she is practicing medicine in the clinic where he or she is supposed to be. Very smart, but unfortunately an exception.

Â

I recently received a tedious written “Request for Evidence” from the immigration service for a permanent residence petition. The Request alone was several pages long. It concerned the CEO of a major international truck manufacturer, asking for further proof that the beneficiary is really an “executive.” Had that officer spent 30 seconds on the internet, he or she would have found that the beneficiary is very well known, he is cited in many articles, and his pictures appear in magazines all over the place. It would have saved the officer and me a lot of time.

Â

With all that in mind, let’s go back more than one year, when it seemed we were so close to a partial fix. The Comprehensive Immigration Reform Act of 2007 (S. 1348) was introduced in May 2007 by Senate Majority Leader Harry Reid, and quickly failed in June 2007. The most noteworthy aspects were: (1) the “Z” visa, which would have put many long-term illegals on the path towards permanent residence. The fines associated with this visa would filled government coffers, and would have added millions of people as orderly tax payers; (2) the “Y” visa, which would have granted hundreds of thousands of “guest workers” the opportunity to work temporarily in the U.S.

Â

A few months ago, I listened to a speech by Secretary Chertoff of the U.S. Department of Homeland Security (DHS), and twice he mentioned the possibility of a “guest worker program, possibly as early as next year. Maybe it was my wishful thinking, but he seemed to emphasize the words “guest worker program” and the possibility “next year.”

Â

So, if there is a chance for a partial fix with the newly elected President (be it McCain or Obama), what can we expect? My guess is that we will eventually see some version of a “guest worker” program, which will grant illegals some kind of status. Let’s just look at this for a moment: many landscapers, nannies, cleaning ladies, and kitchen workers are plain illegal in this country. So are many spouses of United States citizens if they crossed the border without inspection or have had a run-in with the law. High-tech companies are screaming for more H-1B visas (currently 65,000 per year) to bring computer guys and engineers into the country. We have probably between 10 million and 20 million illegals in this country. Something needs to be done.

Â

Of course, it would be best if we could have that 245(i) law return, allow people to be sponsored by their employers or their relatives, and pay a hefty fine. It would bring cash into government coffers, and fully integrate many hard working people into mainstream America.

We all know that criminals are out there, waiting to steal our credit card information. These very criminals want credit card information so they can run up the charges then leave you holding the bags – with nothing to show for it. Even though some are local, most credit card criminals are in far away lands. Worse than that, they like to hide or go by other names so it’s virtually impossible to track them down.

The most common way for criminals to get credit card information is through phishing, which involves a fake email that appears to be sent from your credit card company. Normally, this fake email states that there was an error with your account, or that it was accessed by unauthorized personnel and needs your attention.

Spotting fake emails isn’t hard to do – as long as you know what to look for. The most obvious hint for most, is the fact that they don’t even have a credit card from the company that has sent the email.

For others, the link is what gives the fake email away. Anytime you get an email from a credit card that you believe to be fake, you should always hover your mouse over the link, then “right click” the link with the mouse and select “view source”. If the link is indeed fake, the website address that comes up will be something other than that of a credit card company.

The criminals don’t want you to look at the source for their website, as they simply want you to click on the link before you look at anything else. Once you have clicked on the link, you’ll arrive at a website that is usually an exact copy of a credit card website. Fake sites normally include everything that the actual site does, including the logos and banners. Even for the most amateur of credit card criminals, web pages like this are very easy to create.

Those of you who have fell victim to this scam, probably realized what you have done little too late. Once you have entered in your credit card information, you have done exactly what the criminals wanted and put yourself in violation of credit card fraud and identity theft.

Once the criminal has your social security number and credit card information, he is more than likely to use that information to go on a shopping spree – stealing your money and running up your account.

If you receive an email such as this, you should always delete it. Even if you just click on the fake website to investigate, you may do more harm than good. Even though you may not enter any information at all, your computer may get infected with viruses or spyware simply because you clicked on the link. To avoid this altogether, you should never click on a link that you believe to be a fake credit card company website.
If you do your part and protect your credit card information, you won’t have anything at all to worry about.
